By virtue of the power and authority contained in a Deed of Trust from Jerry Wayne Snapp, Jr. and Stacey Goldie Snapp, dated August 26, 2022, and recorded in Deed Book 3361, Page 2718 at Instrument No. 20220831000124400 in the Clerk’s Office for the County of Hanover, Virginia securing a principal balance of $167,406.00 (the “Deed of Trust”), the holder of the indebtedness secured by said Deed of Trust having appointed as Substitute Trustees KYLE D. KORTE and CHRISTOPHER A. The land referred to herein below is situated in the County of Hanover, State of Virginia, and is described as follows:
ALL that certain lot, piece or parcel of land, with all improvements thereon and appurtenances thereto belonging, lying and being in South Anna District, Hanover County, Virginia, known, numbered, and designated as Lot 17, Section 2 as more particularly shown on that certain plat of subdivision entitled "Red Hill, Sec. 1 & 2", made by Balzer and Associates, Inc., dated November 10, 2004 and recorded in the Clerk's Office of the Circuit Court for the County of Hanover, Virginia in Plat Book 37, Page 185, (previously and erroneously referred to plat dated March 8, 2004, and recorded in the Clerk's Office of the Circuit Court for the County of Hanover, Virginia in Plat Book 3246, Page 3433), to which plat reference is hereby made for a more particular description of the property hereby conveyed.
Together with a non-exclusive variable width easement of right-of-way for ingress and egress as described in Deed of Vacation and Grant of New Easement between Thomas E. Stanley, Jr. and Claudia C. Stanley, and Greenwood Church, LLC dated February 27, 2004 and recorded March 11, 2004 in Deed Book 2278, Page 79.
It being the same property conveyed by deed dated November 30, 2020 from Michael Barry Woods, know of record as M. Barry Woods, to Jerry Wayne Snapp, Jr., and Stacey Goldie Snapp, husband and wife, recorded in the Clerk's Office of the Circuit Court for the County of Hanover, Virginia in Deed Book 3293, Page 1389.
TERMS OF SALE: Cash. A deposit of $30,000.00 or ten percent (10%) of the sale price, whichever is lower, in cash or certified check payable to the Substitute Trustee shall be required of the successful bidder at the time of sale before the bidding will be closed. The balance of the purchase price will be due within fifteen (15) days of the sale at the public auction.
As-is. The property will be sold in an “as-is” condition without warranties of any kind, and subject to conditions, senior liens, restrictions, easements and agreements of record affecting the same, if any.
Written notice of this Substitute Trustee’s sale, as required by Section 55.1-321 of the 1950 Code of Virginia, as amended, has been sent to the property owners as their addresses appear in the records of the noteholder, and to all parties prescribed therein.
